แถลงการณ์พรรคเพื่อไทย

เรื่อง โครงการอุทยานราชภักดิ์

     ตามที่พรรคเพื่อไทยได้มีแถลงการณ์ ฉบับลงวันที่ 13 พฤศจิกายน 2558 และ 19
พฤศจิกายน 2558 เรียกร้องให้รัฐบาลแถลงรายละเอียดและมาตรการดำเนินการต่างๆ กรณี มีการทุจริตในโครงการอุทยาน  ราชภักดิ์ รวมถึงการแสดงความรับผิดชอบของผู้บังคับบัญชาในระดับต่างๆ
นั้น

     ต่อมา
เมื่อวันที่ 20 พฤศจิกายน 2558 ผู้บัญชาการทหารบกได้แถลงผลการตรวจสอบการดำเนินโครงการอุทยานราชภักดิ์
ว่า เป็นไปด้วยความเรียบร้อย ไม่มีการทุจริต ทั้งในส่วนขององค์กรและบุคลากร พร้อมทั้งกล่าวในทำนองว่าไม่มีความต้องการที่จะให้องค์กรอื่นเข้ามาตรวจสอบเรื่องที่เกิดขึ้นภายในกองทัพบกนั้น

     พรรคเพื่อไทยเห็นว่า
การแถลงของผู้บัญชาการทหารบกไม่เกินความคาดหมายในการออกมาปกป้ององค์กรและบุคลากรของกองทัพบก
และเป็นที่เข้าใจดีจากถ้อยแถลงและตอบคำถามผู้สื่อข่าวว่า มิใช่การตรวจสอบกรณีการทุจริต
การตรวจสอบเป็นไปเพียงเพื่อการที่จะเข้าไปดำเนินการต่อในฐานะที่อุทยานราชภักดิ์เป็นของกองทัพบก
โดยให้ถือว่าเป็นเรื่องของอดีตผู้บัญชาการทหารบกที่ต้องตอบคำถามข้อสงสัยกรณีที่มี  การเรียกรับผลประโยชน์ในโครงการดังกล่าว พรรคเพื่อไทยเห็นว่า
ถ้อยแถลง (ตอบคำถาม) ของผู้บัญชาการทหารบก มีข้อที่ต้องพิจารณาและขอเรียกร้องดังต่อไปนี้

     1.
ข้อที่ว่ามีการกระทำผิด มีการทุจริต เรียกร้องผลประโยชน์หรือไม่
ผู้รับผิดชอบโครงการและเป็นผู้นำกองทัพบกในขณะนั้น
ได้ออกมายอมรับต่อสาธารณะว่ามีการเรียกรับผลประโยชน์จริง สอดคล้องกับคำรับของผู้รับจ้าง
ซึ่งขณะนี้ได้เดินทางไปต่างประเทศ โดยผู้รับผิดชอบได้แถลงว่า ได้นำเงินที่เกิดจากการเรียกรับผลประโยชน์ไปบริจาคให้มูลนิธิฯ
(ซึ่งจดทะเบียนในภายหลัง) จึงเท่ากับเป็นการยอมรับว่ามีการกระทำผิดกฎหมายเกิดขึ้น การรับเงินบริจาคที่ได้มาจากการกระทำผิด  นอกจากจะไม่ถูกต้องตามวัตถุประสงค์ของ  มูลนิธิฯ โดยทั่วไปแล้ว
ยังเข้าข่ายเป็นการกระทำผิดทางอาญาอีกด้วย  กรณีเทียบได้กับคดีของอดีตรองอธิบดีกรมป่าไม้ที่นำเงินที่ได้จากการให้สินบนไปบริจาค
โดยนายกรัฐมนตรีในขณะนั้นแต่งตั้งคณะกรรมการสอบสวน และถูกศาลพิพากษาจำคุกในที่สุด

     การจัดสร้างอุทยานราชภักดิ์
มีข้อสงสัยจากสังคมในหลายประเด็น อาทิ การที่นายทหารของกองทัพบกซึ่งถูกแจ้งข้อหาตามประมวลกฎหมายอาญา
มาตรา 112 ปัจจุบันหลบหนีออกนอกประเทศ ถูกพาดพิงว่า  เรียกรับเงินจากผู้รับจ้าง
ความเป็นไปเป็นมาของพ่อค้าพระว่าเข้ามาเกี่ยวข้องกับโครงการและสามารถเรียกร้องผลประโยชน์กันได้อย่างไร
เสื้อที่ใช้ในโครงการซึ่งปรากฏว่ามีการบวกราคา
ข้อเท็จจริงที่ว่ามีการบริจาคต้นไม้ให้แก่โครงการ ปรากฏว่ามีการนำไปขายต่อเพื่อบริจาคในราคาที่สูงมาก
ทั้งนี้ยังมีประเด็นว่าการจัดซื้อจัดจ้าง ตลอดจนการคัดเลือกโรงหล่อทั้ง 6 แห่ง
ได้ดำเนินการตามระเบียบอย่างไรหรือไม่ ข้อเท็จจริงทั้งหลายเหล่านี้เป็นที่เคลือบแคลงสงสัย
แต่ก็มิได้เข้าไปตรวจสอบ แสดงว่าการตรวจสอบเป็นเพียงการดูรายละเอียดตามบัญชีบริจาคที่เข้ากองทุนฯ
และรายจ่ายตามบัญชีเท่านั้น มิได้มีการตรวจสอบการทุจริตแต่อย่างใด และแม้จะมี  การตรวจสอบการทุจริต
แต่ก็เป็นเพียงเรื่องภายในของหน่วยงานเท่านั้น หาได้ยุติสิ้นสุดแต่อย่างใดไม่

     2.
ถ้อยแถลงของผู้บัญชาการทหารบกในลักษณะที่กล่าวมา แม้จะไม่ตอบข้อสงสัยของสังคม แต่ก็  น่าเห็นใจ เพราะท่านเพิ่งจะเข้ามารับผิดชอบและไม่ได้มีส่วนร่วมในเรื่องดังกล่าวมาก่อน
ผู้รับผิดชอบแท้จริง  คือ อดีตผู้บัญชาการทหารบก
รัฐมนตรีว่าการกระทรวงกลาโหมและนายกรัฐมนตรี ซึ่งรับรู้และสนับสนุนโครงการอุทยานฯ
มาตั้งแต่ต้น ที่จะต้องออกมารับผิดชอบ และดำเนินการตรวจสอบอย่างเต็มที่ด้วย  ความโปร่งใส ไม่เห็นแก่ผู้ใด

     แต่รัฐบาลนี้กลับขัดขวางและจำกัดเสรีภาพของประชาชน
เช่น การออกหมายเรียก พล.ต.อ.เสรีพิศุทธ์  เตมียาเวส การออกหมายเรียกคณาจารย์มหาวิทยาลัยเชียงใหม่
การสั่งปิดสถานีโทรทัศน์ฟ้าให้ทีวี
การตัดไฟเพื่อขัดขวางการสัมมนาของนักศึกษาในเรื่องการทุจริตโครงการนี้ที่มหาวิทยาลัยธรรมศาสตร์
การแถลงของรัฐมนตรีว่าการกระทรวงยุติธรรมที่ท้าทายให้พรรคเพื่อไทยไปหาหลักฐานการทุจริตมามอบให้
การกระทำทั้งหลายที่กล่าวมานอกจากจะเป็นการปกป้องผู้กระทำผิดแล้วยังเป็นการข่มขู่
คุกคาม ขัดขวางและปิดกั้นการตรวจสอบ

     3.
เมื่อมีพฤติการณ์ว่ามีการทำผิดกฎหมายเกิดขึ้น โดยเฉพาะการแสวงหาประโยชน์ จากโครงการ
 ย่อมเป็นอำนาจหน้าที่ของ ป.ป.ช. , ส.ต.ง.
, ส.ต.ช. , กรมสอบสวนคดีพิเศษ , ป.ป.ง. ที่จะต้องเข้ามาตรวจสอบได้  แม้ไม่มีผู้ใดร้องขอ
เพราะได้ปรากฏเหตุอันมีข้อสงสัยว่ามีการกระทำผิดเกิดขึ้นแล้ว
กองทัพบกซึ่งเป็นหน่วยงานของรัฐไม่มีเอกสิทธิใดๆ เป็นพิเศษ
ย่อมจะต้องถูกตรวจสอบได้เช่นเดียวกับหน่วยงานของรัฐอื่นๆ  จึงขอเรียกร้องให้หน่วยงานที่กล่าวมาเข้ามาตรวจสอบโดยเร่งด่วนที่สุด
แม้จะมีการตั้งมูลนิธิฯ เพื่อมารับบริจาคและรับผิดชอบโครงการ แต่มูลนิธิฯ ดังกล่าว
ดำเนินการโดยบุคลากรของกองทัพบก ใช้สถานที่ของกองทัพบก ในชั้นแรกมีการบริจาคเงินเข้าบัญชีกองทุนสวัสดิการกองทัพบก
ย่อมเป็นราชการของกองทัพบก
ผู้บริจาคให้โครงการล้วนแล้วเป็นหน่วยงานของรัฐเป็นจำนวนมาก นอกจากนั้นการบริจาคให้โครงการฯ
ก็จะต้องปฏิบัติตามระเบียบกระทรวงการคลังว่าด้วยการรับเงินหรือรับทรัพย์สินที่มีผู้บริจาคให้ทางราชการ
พ.ศ.2526 โดยอยู่ภายใต้การตรวจสอบของสำนักงานตรวจเงินแผ่นดินเช่นเดียวกัน

     4.
พรรคเพื่อไทยขอเรียนว่า โครงการอุทยานราชภักดิ์ มีความสำคัญยิ่งต่อความรู้สึกของประชาชน  ทั้งประเทศ
เป็นโครงการที่เห็นชอบอนุมัติโดยคณะรัฐมนตรี
เมื่อมีการทุจริตเกิดขึ้นและเกี่ยวพันถึงบุคลากร  ในกองทัพ ซึ่งได้รับมอบหมายให้เป็นผู้รับผิดชอบโครงการ
รัฐบาลจึงมีหน้าที่ที่จะต้องดำเนินการหาตัวผู้กระทำผิดมาลงโทษโดยพลัน
จึงขอเรียกร้องมายังนายกรัฐมนตรี ให้ดำเนินการเรื่องนี้อย่างเปิดเผย โปร่งใส
และประกาศให้สาธารณชนทราบต่อไป

Pheu Thai Party Statement

on Rajabhakti Park Project

This statement is In
reference to the previous statements made by Pheu Thai Party dated 13th
November 2015 and 19th November 2015 calling for the government to make announcements
and provide details clarifying corruption allegations concerning the Rajabhakti
Park Project and also to show its
responsibility of the commanding officers of various ranks.

Subsequently, on the
20th November 2015, the Army Chief made an announcement on the findings on the
operations of the Rajabhakti Park Project and concluded that there had been no
irregularities or corruption both with the organization and the personnels. He
also stated along the line that there was no need to involve other organizations
to further investigate into the affairs of the army.

Pheu Thai Party sees that the announcement
made by the Army Chief to protect the organization and personnel of the Army is
not beyond expectation. It is understood by the words spoken and responses made
to the inquiries of the journalists that this is not to investigate the corruption
allegation but is only an examination for the continued operation of the Rajabhakti
Park that the Army is responsible of. As for alleged demand for benefits, the
former Army Chief must be the one to respond to those questions. In reference
to the announcement (response) made by the Army Chief, Pheu Thai Party sees
issues that must be considered and requests the following:

1. Concerning the issue of whether any offense
or corruption have occurred, the person responsible for the project and the
leader of the Army at that time have already conceded to the public that there
were incidents of demands for benefits which is consistent with the words by
the contractors. He is presently overseas but have said that the money that
came from such demands have already been donated to the Foundation (which was
registered later). This is equivalent to admitting that illegal conducts had
occurred and receiving donation money from this not only violates the general
objective of the Foundation but is also a criminal offense. This is similar to
the case of the Director General of the Department of Forestry diverting
corruption money as donation. During that time the Prime Minister set up an
investigative panel, and ultimately was ordered imprisonment as judgement by the
Court.

The building of Rajabhakti Park had raised
many questions from the public, such as the allegation that an army officer
charged with violating Article 112, who is currently on the run overseas, made
demands for commission from the contractors; how an amulet trader could become
involved in the Project and was able to make demands for benefits; the dress
used in the project which was found to be overcharged;  the facts that certain trees were donated to
the Project but was resold for exorbitant donation money. There are also
matters concerning procurement and the selection of the 6 foundries, whether
they were done in accordance with the regulations or not. These issues have
raised suspicions, but they were not investigated which means that only the
details of the money donated into the accounts and expenditures as recorded in
the accounting books were examined, and no cases of corruption were probed. And,
even though there may be investigation of corruption, this has only been regarded
as an internal affair and offers no conclusion.

2. The announcement by the Army Chief in such
manner, although failing to answer the questions of the public, but this is
understandable as he has just assumed responsibility and have never taken part
in the matter. The person actually responsible is the former Army Chief, the
Minister of Defense and the Prime Minister who had knowledge of the Project from
the start and must show their responsibility in the matter by proceeding to
conduct a transparent and impartial investigation into the matter.

However, this Government instead obstructs and
limits the liberties of the people such as summoning Pol. Gen. Sereepisuth
Temeeyaves, summoning the lecturers of Chiangmai University, closing down Fahai
TV Station, cutting electricity supply to thwart the seminar held by Thammasart
University students concerning Corruption of this Project, the announcement by
the Minister of Justice that challenged Pheu Thai Party to find and submit
evidence of corruption. These conducts mentioned not only protect the offenders
but also threaten, intimidate, hinder and obstruct any investigation.

3. When there are behaviors that illegal
offense have occurred especially in seeking benefits from the Project, the
National Anti-Corruption Commission, the Auditior General, the Royal Thai
Police, Department of Special Investigation, Anti-Money Laundering Office must
have the power to investigate into the matter even when no one has made such
requests since the incidents that point to such offense taking place are
evident. The Army is a government organization that does not have special
privilege and must be examined like any other government organizations. Thus,
these organizations should launch investigations, most urgently. Although a
Foundation has been established for accepting donations and operating the
Project, but since the Foundation is run by military personnel, uses the venue
of the Army and initially money was donated to the account “The Army’s
Welfare Fund” that belongs to the Army with numerous government organizations
as donors. And since this is donation made for the Project it must also abide
by the regulations of the Department
of the Treasury concerning the receipt of money or assets made by donors to the
government B.E. 2526 which is under the supervision of the Auditor General.

4. Pheu Thai Party would like to state
that Rajabhakti Project is very ivital to the feelings and sentiments of
the people in the entire nation. When
there is corruption which involves personnel in the Army who is responsible for
the Project, the Government  has the
obligation to urgently find the offenders and put them through the punitive process.
Therefore, the Prime Minister is implored to proceed with this matter in an
open and transparent manner and make announcements to the public.
